Is It Legal to Grow Marijuana in California?

  • You should make sure that your plants are out of sight and secured in a safe area of your home. This will dissuade break-ins and theft.
  • When growing your own pot plants, you must adhere to growing no more than 6 plants. However, you may freely keep all of the available harvests that come from those 6 plants.

There’s more. You aren’t allowed to openly grow plants in your backyard if you’re next to a public setting, like a school or park, for example. To do so would be breaking the law. This is why some cities have stricter rules than others on outdoor growth. 

By the book

It’s important to understand that you may keep as much weed as you can grow from your 6 plants. Hypothetically speaking, if you were somehow able to yield 10 pounds of weed from your plants, you would be allowed to keep every single gram.

However, there is a limit to what you can legally carry on your person at one time. As we noted above, that limit is 28.5 grams. It doesn’t matter if you’re going to a friend’s to smoke or you are gifting some of your weed. At no time may you leave your house with more than 28.5 grams of marijuana.

To ensure that you are always adhering to the law, you should invest in quality scale. And if you really want to play it safe, weigh out slightly less, like 28.3 or 28.4 grams.

A sticky situation

Now, with all of that being said, there are some remaining factors that need to be cleared up. While it’s true that the state law says it is now legal to grow marijuana in California, there are some cities that prohibit it.

Each city has its own laws in place regarding the outdoor growth of pot. Yes, you can grow it, but you should always make sure that it’s under wraps to avoid any potential issues. You should also grow your weed while following the adage “Out of sight, out of mind.”

As long as no one can readily see what you’re going on your own private property, you shouldn’t have any trouble. Just keep in mind that if you get caught, you will be in violation of the law.

If you want to avoid this potentiality, stick to growing indoors only. The law clearly states that no city can prohibit you from growing weed in the confines of your home. If you’re still unclear as to what your rights are, speak to an attorney.

Don’t get greedy

It goes without saying, but you never want to try to make a profit from your personal growth. Selling your marijuana is a big no-no that will land you in hot water in no time flat. The buying and selling of weed should be left to a legal marijuana provider.

Growing more pot than what you are allowed is another bad decision that won’t be looked kindly upon if you are found to be doing so. In the eco-conscious state of California, you’re asking to have the book thrown at you if you break this law.

And lastly, respect those around you and don’t plant outdoors if it’s going to cause dissension between you and your neighbors. Although it might be allowable in the city in which you live, avoid doing so if it’s going to keep the peace. Just because you can, it doesn’t mean you should.
